Our public sector client is seeking a Commercial Manager to oversee the delivery of commercial activities, processes, and systems within the Capital Programmes Directorate. This role is crucial for managing and orchestrating all commercial stakeholder parties to develop and maintain commercial control of programmes and projects. The ideal candidate will have extensive knowledge of Post Contract Management of complex and/or bespoke contracts, ideally with experience in the rail industry and an understanding of intellectual property rights in contracts.
Day-to-day of the role:- Manage the commercial activities and their interrelation on major work-streams, projects, and programmes to deliver commercial control, including identifying and assessing potential risks to commercial agreements and supplier performance.
- Plan, deliver, and manage all procurement activities to deliver contracts and frameworks for works, goods, and services contracts.
- Manage estimating and cost planning using construction and engineering industry market economics and understanding their impact on cost and price.
- Oversee construction, engineering, supply, and service contracts.
- Prepare detailed analysis of variances and explanations, and understand the concept of, and ability to calculate, earned value.
- Formulate negotiation parameters, analyse and interpret commercial data, and demonstrate flexibility whilst achieving negotiation objectives.
- Manage claims, mitigation, and advising on the defence of claims, including analysis of the various parties’ positions.
- Chair performance meetings with suppliers, communicate performance data, and agree on improvement plans.
- Supervise a team of Commercial Managers, Assistant Commercial Managers, Cost Managers, and/or Assistant Cost Managers, including a project administrator if appropriate.
- Extensive knowledge of Post Contract Management of complex and/or bespoke contracts.
- Ideally, experience in the rail industry and knowledge of intellectual property rights in contracts.
- Proficient in JCT / ICE / NEC forms of contract and their differences.
- Strong project management skills including Programme and Project Management (PPM) methods and practices.
- Proven experience managing complex customer and supplier relationships and expectations in a project environment.
- Ability to produce estimates for major schemes appropriate for all design stages.
- Knowledge of Construction and Case Law in relation to Claims Management.
