The Law Collective's teams are bilingual (Spanish/English) to serve clients across its markets.

Job Summary

The Litigation Attorney is responsible for handling personal injury cases once a lawsuit has been filed, managing each case from the initiation of litigation through trial, settlement, or resolution. This role takes over cases that could not be resolved during the pre-litigation phase and is responsible for building and executing the litigation strategy needed to secure the best possible outcome for the client.

Key Responsibilities
  • Draft and file complaints and other pleadings to initiate lawsuits
  • Propound and respond to written discovery — Form Interrogatories, Special Interrogatories, Requests for Production, and Requests for Admission — analyzing responses and document productions for evidentiary value and case strategy
  • Handle meet and confer efforts and draft/argue Motions to Compel when discovery disputes arise
  • Prepare Expert Designations and coordinate expert disclosure deadlines
  • Take and defend depositions of plaintiffs, witnesses, and expert witnesses
  • Retain and coordinate expert witnesses (medical, biomechanical, accident reconstruction, etc.) as needed for case strategy
  • Draft and argue motions, including Motions for Summary Judgment and related pleadings
  • Represent clients at mediations, arbitrations, and settlement conferences
  • Negotiate settlements throughout the litigation process, including making policy-limit demands and/or 998 offers
  • Prepare cases for trial and represent clients at trial when a case does not settle
  • Coordinate with Case Managers and Pre-Litigation Attorneys to ensure a smooth handoff when a case escalates to litigation
  • Keep clients informed of case status and strategy throughout the litigation process
  • Able to use AI efficiently through discovery, deposition, and through out the litigation process. 
  • Juris Doctor (JD) and active license to practice law
  • Proven experience in personal injury litigation, including discovery, depositions, and motion practice
  • Experience negotiating with insurance carriers and/or opposing counsel
  • Trial experience preferred but not required
  • Ability to manage a caseload of active litigation matters simultaneously
Desired Skills (nice-to-have, not disqualifying)
  • Experience with Motions for Summary Judgment and dispositive motion strategy
  • Experience coordinating expert witnesses
  • Bilingual Spanish/English preferred but not required
