Member Status Required: No Appointment Term by the Quapaw Nation Business Committee: N/A GENERAL DUTIES AND RESPONSIBILITIES: Under the direction and review of the Quapaw Nation Gaming Commission, the QNGA Administrator shall diligently oversee the QNGA staff to assure that the following statutory duties of the QNGA are fulfilled: ESSENTIAL JOB FUNCTIONS: Manage day-to-day operations of the team or function Assign tasks, set priorities, and monitor performance Coach employees, conduct evaluations, and manage hiring and disciplinary actions Implement strategies established by senior leadership Manage departmental budgets and resources Conduct background investigations, or cause such investigations to be conducted, for Primary Management Officials and Key Employees and Security and Surveillance Employees Create and maintain investigative reports based on the background investigations of Primary Management Officials and Key Employees and Security and Surveillance Employees Designate a law enforcement agency to obtain and process fingerprints and conduct a criminal history check that shall include a check of criminal history records information maintained by the Federal Bureau of Investigation Make licensing eligibility recommendations to the Gaming Commission, which, if approved, shall be signed by the Gaming Commission Prepare a notice of results to the NIGC of the background investigations done for each Primary Management Official and Key Employee applicant Provide the Gaming Commission with recommendations regarding the issuance or non-issuance of gaming licenses to Primary Management Officials and Key Employees based upon background investigations conducted pursuant to the Quapaw Nation Gaming Ordinance Recommend standards for adoption by the Gaming Commission regarding licensing of Gaming Enterprises in accordance with applicable federal regulations, Nation law, and, if applicable, standards contained in the Tribal-State Compact Provide the Gaming Commission with recommendations regarding the issuance of gaming licenses for Gaming Enterprises within the reservation Inspect, examine, and monitor all of the Nation’s gaming activities within the reservation, and have immediate access to review, inspect, examine, photocopy, and audit all records of the gaming facilities and operations Investigate any suspicion of wrongdoing associated with any gaming activities and prepare reports thereof for review by the Gaming Commission, and prepare any recommendation for the Gaming Commission to add a person associated with such wrongdoing to the list of persons not allowed to game in the Quapaw Nation’s gaming facilities in order to maintain the integrity of the Gaming Enterprise Prepare all reports necessary to comply with all reporting requirements under IGRA, the NIGC’s regulations and any Tribal-State Compact to which the Quapaw Nation is a party, and any other applicable law Propose regulations necessary for adoption by the Quapaw Nation Gaming Commission to comply with the MICS Propose regulations for adoption by the Quapaw Nation Gaming Commission on the levying of fees and/or taxes associated with gaming license applications Propose regulations for adoption by the Quapaw Nation Gaming Commission on the levying of fines and/or the suspension or revocation of gaming licenses for violations of the Quapaw Nation Gaming Ordinance or any Quapaw Nation, federal or applicable state gaming regulations Receive from the Gaming Enterprise a list of persons not allowed to game in facilities in order to maintain the integrity of the Gaming Enterprise Receive from the Gaming Enterprise a list of persons who have voluntarily agreed to be excluded facilities, and assist in the creation of regulations for enforcing the exclusions Provide referrals and information to the appropriate law enforcement officials, in accordance with the Tribal-State Compact as well as applicable tribal and federal law, when such information indicates a violation of Quapaw Nation, federal or state statutes, ordinances, regulations, codes or resolutions Recommend to the Gaming Commission a list of trustworthy tribal or commercial gaming regulatory entities, which can conduct background investigations and assisting in the licensing of, vendors and Gaming Enterprise employees as required under applicable law Propose regulations for adoption by the Gaming Commission exempting vendors from the licensing and/or background investigation requirements if they have received a license from a recognized regulatory authority Perform such other duties consistent with the Quapaw Nation Gaming Ordinance that the Commission deems appropriate for the proper regulation of the Gaming Enterprise Prepare and recommend that the Gaming Commission adopt such regulations and guidelines as the Gaming Agency deems necessary to implement the provisions of the Quapaw Nation Gaming Ordinance, so long as they are in furtherance of, and not in conflict with, any provisions of the Quapaw Nation Gaming Ordinance Performs all other duties as assigned QUALIFICATIONS: To perform this job successfully, the individual must be able to perform each essential job function satisfactorily. The requirements listed below are representative of the knowledge, skill, and/or ability required. Education: Must have a bachelor's degree in business or equivalent business/administrative experience with a minimum of two (2) years' experience in the gaming field or regulatory authority. Language Skills: Must be proficient in writing skills, including but not limited to preparing governmental correspondence and all types of forms, reports, correspondence, and other communications. Must have the ability to read, analyze, and interpret rules, regulations, policies, and procedures. Communication Skills: Must be able to communicate effectively and provide leadership to QNGA staff in carrying out the agency’s statutory responsibilities. Must be able to interact professionally with other Quapaw Nation departments and agencies, federal and state agencies, casino management and staff, and law enforcement agencies Must be capable of presenting information clearly and responding to questions from employees, managers, and patrons. Strong communication skills and the ability to work cooperatively with others are essential. Physical Requirements: Must be physically able to perform the essential functions of the job. While performing the duties of this job, the employee is regularly required to sit and stand; reach with hands and arms; write, review, and type reports; compile data; operate a computer; communicate; listen; and assess information. Other Skills and Abilities: Maintain a current driver’s license in good standing and qualify under the Quapaw Nation Motor Vehicle Policy. Must be organized; possess intermediate computer skills; and be able to operate standard office equipment. QualificationsOTHER REQUIREMENTS: Background Investigations: All applicants are subject to a background check, which includes a review of criminal history and verification of professional references. Individuals who have been convicted of any gambling or bribery offense, or any felony, are not eligible to serve as Administrator. Drug Testing: Employees must pass a pre-employment drug screen prior to commencing employment and may be subject to random drug testing during employment. Confidentiality: All QNGA employees must agree to a Confidentiality Agreement with the QNGA and/or the Nation as a condition of employment. Any breach of the Confidentiality Agreement may result in dismissal. Prohibited Conduct: All QNGA employees are required to follow the Quapaw Nation’s personnel policies and procedures. QNGA employees are prohibited from participating in any gaming activities or promotions at any Quapaw Nation gaming facility. Additionally, employees are not permitted to handle any matter in which the subject is an immediate family member or an entity in which they have a pecuniary interest.
